Tell Sen. Patty Murray: 'Due process IS America'

Tomorrow morning, the Senate HELP Committee will hold a hearing on "Addressing Campus Sexual Assault and Ensuring Student Safety and Rights."
In the past, Sen. Patty Murray, who is the highest ranking Democrat on the Committee, has often pushed the "one in five" fake statistic in order to justify the existence of the campus Kangaroo Courts.
Somehow, Murray has forgotten that all Americans, including college students, are guaranteed due process by the Constitution.
So please telephone Murray's office at (202) 224-2621. Tell her, "Due process IS America!"

Support Betsy DeVos for Secretary of Education
President Donald Trump’s pick for Education secretary, Betsy DeVos, has cleared the first hurdle in her confirmation process.
The Senate Health, Education, Labor and Pensions Committee approved DeVos on Tuesday afternoon in a 12-11 vote that fell along party lines.

Democrats had strongly opposed DeVos’ nomination during her Jan. 17 confirmation hearing. They pressed her on her extended family’s support of organizations that promote conversion therapy and whether she would support gun-free zones in schools. DeVos was mocked in the media for her answers to both questions, even though she denied supporting conversion therapy and her answer on gun-free zones revolved around the notion that a far-off federal bureaucracy might not be the best judge of the unique needs of individual schools.
DeVos was also questioned on campus sexual assault and the Obama administration’s guidance documents that require schools to more forcefully adjudicate accusations with almost no ability for accused students to defend themselves. DeVos wouldn’t commit to upholding Obama-era guidance documents, stating that she would ensure the law is carried out in a way that protects accusers and the rights of the accused.
This, naturally, didn’t sit well with Democrats and activists, who argue that guaranteeing due process for accused students is tantamount to harming accusers.
In opposing DeVos, those against due process rights and school choice (which DeVos strongly supports), created the hashtag “Dump DeVos,” hoping to influence senators. It only worked on Democrats, who were already going to oppose Trump’s nominee.
DeVos’ nomination now moves to the full Senate. Republicans are in the majority, but two GOP members who supported her in committee — Susan Collins of Maine and Lisa Murkowski of Alaska — have not committed to voting to confirm her on the Senate floor.

We don't usually speak up for women here but this time we will make an exception. This woman has donated and support FIRE which is looking out for falsely accused male students on college and university campuses nationwide. She favors due process rights for the accused male student. That is very fair. I say we support Betsy DeVos for Secretary of Education by contacting our Senators and letting them know to support her Secretary of Education. The more of us they hear from the better.

Rights group calls on presidential candidates to denounce 'victim-centered investigations'

An organization dedicated to overturning and preventing wrongful convictions is calling on presidential candidates Hillary Clinton and Donald Trump to denounce "victim-centered investigations."
The Center for Prosecutor Integrity works with prosecutors, defense attorneys, law enforcement and the falsely accused to prevent wrongful convictions and over-criminalization. The group says victim-centered investigations have led and will lead to more wrongful convictions and false accusations.
"Victim-centered investigations emphasize the collection of evidence supportive of the complainant and discourage the collection of exculpatory evidence, thereby increasing the likelihood of a guilty verdict," the group wrote in a press release. "Victim-centered investigations represent a departure from ethical standards of investigative impartiality, neutrality and objectivity."
Both the Democratic and Republican Party platforms discussed fairness in accusations of sexual assault, specifically on college campuses. But requiring victim-centered investigations removes fairness, as investigators — whether actual law enforcement or campus bureaucrats — are told to believe accusers and pressured by the federal government to punish the accused no matter what the evidence shows.
As I've written before, one of the few times the general public was able to review just what constituted a "victim-centered" investigation, the results were unnerving. Investigators were outright told that false accusations are rare (so best not to ever disbelieve the accuser) and to predict what a likely defense would be, so as to counteract it during the investigation.
Investigators for the University of Texas system were told not to repeat questions with accusers (or not to take notes when doing so), so that there would not be evidence of inconsistencies that could be an indication the accuser was lying.
The CPI press release mentions the case of a young man who was accused of sexually assaulting a woman even though he had never been to the town the alleged assault was said to have occurred.
The group called for Clinton and Trump to endorse a "justice-centered" approach that "protects due process, preserves the presumption of innocence and utilizes an impartial evaluation of all evidence."
Accusers, CPI notes, should be treated with respect and taken seriously, but investigators must remain impartial. I've previously advocated for a "trust but verify" approach, which would ensure accusers aren't disbelieved from the start, but that the accused would also not be treated as guilty from the beginning.
Trump hasn't mentioned campus sexual assault during his campaign, but Clinton has tweeted that we should "listen and believe" anyone who makes an accusation (unless they're accusing her husband, of course).

As you can plainly see that as far as men's rights go Hillary is a lost cause. The proof is here and here. Which is causing this and rightfully so. That means our best bet is with Donald Trump. So contact him at facebook or send him a tweet and let him know that we are very concerned about this. The more of us that contact him the better so don't delay.

So that's who's behind it
College association calls civil-rights agency a ‘Star Chamber’
It may have confused some observers why a constitutional law professor-turned-president would preside over the most blatant denial of due process rights to college students in recent history.
An intriguing Washington Post analysis might have the answer: President Barack Obama ceded all responsibility for campus sexual-assault to his vice president before they were even in office.
And Joe Biden has proven a zealot without any regard for the rights of students who face accusations bereft of any evidence beyond an accuser’s oft-fuzzy memory:
Biden said he spoke to Obama about the issue even before they won the White House in 2008, requesting a staff to work on violence against women “within the office of the vice president,” rather than at the Justice Department.
“He said, ‘Okay.’ He knew how strongly I felt about it,” Biden said, adding that over time Obama became more engaged with the issue.
Biden’s influence has apparently led the White House to judge all colleges that provide a fair process for accused students as cavalierly harboring rapists:
According to White House officials, top members of the administration — including the president, the vice president, their wives and members of the Cabinet — will not visit institutions whose leaders they consider insufficiently serious about pursuing sexual-assault allegations and punishing perpetrators.
Biden told the Post he also wants the feds to “take away their money” if schools provide basic fairness to accused students.
That echoes the federal funding threats made by the Department of Education’s Office for Civil Rights (OCR) when universities don’t immediately turn their adjudication proceedings into a fait accompli, as happened at Tufts University in 2014.
An official with the American Council on Education, which represents 1,600 college and university presidents at the federal level, aptly characterized OCR as “a Court of Star Chamber, with arbitrary rulings, no rights for those under investigation and a secret process” governing schools who fall under Title IX investigation.
Meanwhile, the legality of OCR’s “guidance” on Title IX is the subject of at least three federal lawsuits by students or their parents – meaning it’s likely that whoever succeeds Obama and Biden will have to clean up the legal mess they left.

Georgia lawmaker stands up for due process for accused students

We have a victory! Georgia state representative Earl Ehrhart, Chair of the Georgia Appropriations Committee, held a hearing on Monday about due process on college campuses.
During the hearing, he grilled college administrators on why they don't provide due process to students, threatening that the schools will not get funding if they don't immediately start providing fundamental due process protections:see video

Tell President Obama to observe due process according to the Constitution
Summary Execution Is Not Due Process President Obama told CNN this fall that he can kill Americans or non-Americans, the difference being that with Americans their killing amounts to their Constitutionally guaranteed due process.
CNN asked Obama how he chooses names for his kill list, but he declined to say. Obama claimed that there are checks on his power, pointing only to checks by his own subordinates, not by courts, not by Congress, and not by the public -- which he reassures with vague statements that amount to "trust me."
Obama claimed that his preference is to capture people rather than to kill them. This does not fit with cases like that of Tariq Khan, a 16-year-old killed by drone strike following his participation in a conference at which he could have easily been captured. It does not fit with the lack of criminal charges against virtually any of the people killed.
Obama claimed that he avoids killing civilians, yet careful research has documented large numbers of civilians killed.
Tell President Obama to live up to his own rhetorical support for the rule of law and due process.

Let's make sure probable cause arrest is included in VAWA

Democrats and Republicans in the House have each introduced their own versions of the Violence Against Women Act (VAWA). While we applaud some improvements, there is still work to be done.
Persons accused of domestic violence deserve their due process. And they certainly don't get that with mandatory arrest. Unfortunately, it was not removed from VAWA, by either side.
One in six Americans know someone who has been falsely accused of domestic violence.
During a recent trip to Capitol Hill, I happened to meet three different legislative staffers who had a friend or loved one who had been falsely accused. They know...but they need to hear from you.
Call your Representatives in Congress and demand that VAWA require probable-cause evidence for domestic violence arrests.

Probable cause is good thing to have encoded into law for without it the cops could arrest anyone they didn't like so including it in VAWA would be a good thing. If you feel the same way then by all means call and/or email your Congressional Representative.

Fight for the future by opposing internet censorship today

Can you believe this? After the largest online protest in history, the Obama administration is still voicing support for SOPA.
We promised to ask for your help if SOPA returned. We're asking now. This kind of backtracking demands a strong, fast response. We're running a petition to demand that Obama drop all support for internet censorship. Our goal? Get more signatures than the top petition on whitehouse.gov -- 151,000 signatures. Tell Obama to promise: "I will never advance legislation that blocks websites or disconnects Americans’ internet access.”
What is the White House working on exactly? Just the other day, the administration sent a letter to Congress to demonstrate their support for new internet censorship legislation. A few weeks ago, the White House struck a deal to give corporations private powers to shut down your internet connection (after "six strikes" without due process or judicial review), completely in secret.
Obama's internet would let private companies block sites and turn off our web connections. Blocking websites censors free speech, hurts jobs, and breaks the internet. These are tactics used by totalitarian governments and we believe they’re never ok. Let's get more signatures than any petition on whitehouse.gov.
As Wired noted*, "The White House did say that it wouldn't endorse a bill that endangers freedom of expression, increases cybersecurity risks, or negatively affects the DNS system. On the other hand, it says elsewhere that "combating online infringement" -- not protecting free speech -- is a governmental priority "of the highest order." What about free speech, Obama?
Sign the petition now, then share it to keep the internet strong. Our friends need to know where the President is currently standing on SOPA.
We couldn't have stopped SOPA and PIPA without you and all of your friends! And we can't do it without you now. Let's make sure SOPA 2.0 never gets written. Thank you,

Free speech advocates,such as myself,need to keep them honest and the best way to do that is with an uncensored internet. An uncensored internet is a threat to the PTB and they know it.
