University of Michigan Student Found Guilty of Sexual Assault & Expelled - No Trial, No Jury, No Witnesses, No Attorney
Suzanne Hamner May 9, 2014
It seems the University of Michigan has followed the recommendations in the White House Task Force report entitled "Not Alone" to enact a four-year suspension against a student who was found guilty of the charge of sexual assault – "despite receiving little notice of the charges against him, no attorney, no trial and no jury." Drew Sterrett, the former University of Michigan student, is now suing the institution for violating his rights guaranteed by the US Constitution due process amendments. The incident occurred in 2012, Sterrett's freshman year.
According to The Daily Caller, Sterrett had sex with a female student in his dorm room. According to Sterrett, his roommate was present during the encounter and could attest to it being consensual. While at home for summer break, five months later, Sterrett was informed by the university the female student had filed a rape complaint against him. The university told Sterrett any time in trying to procure a lawyer would result in the proceedings commencing without him. In a hearing via Skype communication later that day, Sterrett denied any wrongdoing.
"'At no point during the call/interview was [Sterrett] given notice of the specific allegations which had been made against him,' the lawsuit claimed."
Sterrett's accuser had second thoughts about the details of their encounter being made public resulting in the investigation being halted in September. He was warned to stay away from the dorm where his accuser resided while being totally unaware of the full accusations against him. The university proceeded to adjudicate the matter anyway resulting in administrators informing Sterrett "he was found guilty of raping his accuser and creating a 'hostile environment' for her, and would be suspended until 2016."
Sterrett denied the charges. He called them "ludicrous" and claimed the proceedings were "a gross perversion of justice." The university denied Sterrett adequate representation and the opportunity to address the specific allegations against him made by his accuser. Regardless, a university appeal board upheld the suspension.
The lawsuit filed by Sterrett maintains, "the decision of the Appeals Board was a rubber stamp of the flawed investigation and Report and Addendum, lacked fundamental fairness, was reckless, arbitrary and capricious, and clearly denied [Sterrett] due process." The lawsuit demands the university reinstate Sterrett and pay damages.
The University of Michigan denied any wrongdoing. Kelly Cunningham, a spokeswoman for UM, said, "The University is reviewing the complaints and plans to defend them vigorously."
In a recent article regarding the White House Task Force report "Not Alone" and its falsification of facts, the problems with these "recommendations" for college campuses, that were urged to be put in place as soon as possible, were the removal of the rights of due process afforded all citizens of the US, upheld by the US Constitution with the Fifth and Sixth Amendments, already in place on some campuses with the administration praising those institutions that arbitrarily dispensed with the rule of law in regards to complaints of sexual assault and rape. As stated in the previous article, this dispensation of the right to due process affects everyone's children regardless of political affiliation, political viewpoint, religion, creed, national origin, race or socioeconomic status. And, it could cause irreparable harm to those who are falsely accused or a complaint filed because of revenge or a prank.
While liberals and those on the left cheer the administration when it participates in violations of law that promote their cause, these individuals have heralded the dismissal of "the rule of law" on college campuses, recommended by the Obama administration, in favor of the "rule of men." In their thinking, the rules would not apply to them as the administration is "liberal friendly" seeking to thwart conservatives and those believing in the rule of law – the law of the land, the US Constitution. However, they too will bear the fruits of their labors.
Whether this student is innocent or guilty is not the issue – the issue is the removal of the right of due process upheld in the US Constitution by an institution, individual, or group that does not have the right to eradicate individual God-given rights.
While all of us would like to believe that our children do not or would not engage in casual sexual activity, it has become evident this does happen and happens at earlier ages: sometimes despite the teachings of parents. In this case, the accused claims the encounter was consensual and even reported having a witness to verify that fact. In the report, "Not Alone," the definition of sexual assault is to be redefined that may include many innocent situations, possibly a consensual situation between individuals of consenting age. Unfortunately, Drew Sterrett has been caught up in a war between the upholding of the rule of law versus the implementation of the rule of men. He will end up paying the price while the posturing of Congress, this administration and the public continue.
The left is busy condoning debauchery at every level, destroying the family unit, and promoting the early sexualization of our children; then, this group has the audacity to support the eradication of due process. Sterrett believed he was not in the wrong by engaging in consensual sexual relations, so did not worry about the encounter. It is proving costly as he attends a university who denies due process to those accused of wrongdoing.
The liberal left needs to re-evaluate their mantra. Oh wait, that would mean that a right-wing extreme woman that someone let out of the kitchen where she needs to be kept was actually right about the consequences of trampling the US Constitution. Well, sometimes that chicken comes home to roost.

I guess dear colleague didn't go over so well so now we have not alone, which is another misandric assfucking from this administration. The weird thing is that the administration making our lives hell is the same one that put together a fucking website that didn't work for shit. In fact it was a running joke on FOX news. All this administration has done is managed to piss off everyone and make them sue the government. I'll bet Biden is the brains on this one,it is that asinine.
My thoughts on pro-masculism and anti-feminism. Some thoughts may mirror what others have said while others are uniquely mine but either way they are legitimate.

Be vigilant during the lame duck session of Congress
To send the mailgram click here
What we have in Congress right now is a lame duck session where it is still under the control of outgoing members until January when the new Congress is sworn in. This includes both houses. It is up to us to keep them honest in their final days in Congress. In this case we are putting our senators on notice that we are watching them and that will lobby to keep our civil liberties intact. If this sounds good to you send the mailgram.

Help rescind the "dear colleague" letter
Students returning to campuses are facing the curtailment of student civil rights, thanks to a 2011 U.S. Department of Education (DED) sex assault mandate. Stop Abusive and Violent Environments (SAVE) is calling on the federal agency to retract the Directive, and restore due process to campuses across the nation.
Under the policy, rather than the usual "reasonable doubt" standard used in courts of law, colleges are now mandated to use the 50.1% "preponderance of evidence" standard when adjudicating claims of sexual assault.
Release of the Directive has resulted in a number of high-profile debacles across the country:click here

SAVE wants to stop the Directive from inviting false allegations, which harm the credibility of true victims and dissipate needed services for victims.
Help us convince the DED to rescind the Directive. Sign the petition: sign the petition or write to Secretary of Education Arne Duncan: arne.duncan@ed.gov.

Tell the Democrats and Republicans not to fuck with the net
Over the next few weeks, the Democrats and Republicans will hold conventions and adopt platforms to tell voters where they stand on key issues. Platforms help define legislative priorities for the parties and the lawmakers who belong to them: Adopting strong Internet freedom language will help ensure that we'll never have to deal with another SOPA or CISPA.
This political ritual only happens once every four years, so we have just days to demand that the two dominant parties make Internet Freedom a priority.
Sign our petition to the Democratic and Republican officials responsible for drafting their party platforms. Tell them to adopt the following language:
"The Democratic/Republican Party stands for a free and open Internet, unfettered by censorship and undue violations of privacy."
It's about time for the Democratic and Republican parties to stand up for Internet Freedom -- and to do it in writing. 2012 has been a landmark year for those who believe in the right of Americans to share information and communicate with each other free from censorship and surveillance.
At the start of the year, we joined together to defeat the Internet Blacklist Bills (SOPA & PIPA), and just days ago we defended online privacy by stopping heavy-handed cybersnooping legislation. Along the way, members of both parties lined up against us. Join us as we tell the Democrats and Republicans to make Internet Freedom a

U.S. Government persecutes U.K. subject
Join Wikipedia Founder Jimmy Wales: Protect Internet Freedom And Seek Justice for Richard O'Dwyer
Hi, I am Jimmy Wales, founder of Wikipedia, and if you care about justice and the future of Internet freedom, Demand Progress and I need your help. This will only take a few seconds, but you can really help us change things for the better.
Richard O'Dwyer is a 24 year old British student at Sheffield Hallam University in the UK. He is facing extradition to the USA and up to ten years in prison, for creating a website - TVShack.net – which linked (similarly to a search-engine) to places to watch TV and movies online.
O'Dwyer is not a US citizen, he's lived in the UK all his life, his site was not hosted there, and most of his users were not from the US. America is trying to prosecute a UK citizen for an alleged crime which took place on UK soil.
The Internet as a whole must not tolerate censorship in response to mere allegations of copyright infringement. As citizens we must stand up for our rights online.
Please sign on at right here to join me in demanding that British authorities refuse to extradite O'Dwyer, and that US officials cease persecuting him.
When operating his site, Richard O'Dwyer always did his best to play by the rules: on the few occasions he received requests to remove content from copyright holders, he complied. His site hosted links, not copyrighted content, and these were submitted by users.
Copyright is an important institution, serving a beneficial moral and economic purpose. But that does not mean that copyright can or should be unlimited. It does not mean that we should abandon time-honored moral and legal principles to allow endless encroachments on our civil liberties in the interests of the moguls of Hollywood.
Richard O'Dwyer is the human face of the battle between the content industry and the interests of the general public. Earlier this year, in the fight against SOPA and PIPA, the public won its first big victory. This could be our second.
This is why I am petitioning the UK's Home Secretary Theresa May to stop the extradition of Richard O'Dwyer, and asking the United States to end his prosecution. I hope you will join me.

This is the same government that doesn't do shit in the middle east, ignores Pro-American sentiment amongst the Iranian youth yet they can persecute some guy running a tv guide style website. This is rediculous and the U.S. government should just hang it up on this one. If you feel the same way sign the petition.

Support the amendment to NDAA
From Demand Progress:
NDAA Vote Next Week: End Indefinite Detention!
We can put an end to a shocking assault on our civil liberties: Last year's National Defense Authorization Act included language that could allow the military to detain civilian suspects INDEFINITELY without charge or trial.
This year's NDAA could come up for a vote as soon as next week and we have a prime opportunity to reverse this travesty of justice.
Congressmen Adam Smith and Justin Amash will put forth an amendment to make it clear that the military does not have the power to arrest and indefinitely detain civilians without charging or trying them. Please urge your lawmakers to support their efforts and help us spread word far and wide.
Source:click here
The military arresting people is business as usual in some countries. Perhaps that explains why a lot of people want to get out of those countries too. America has always been under civilian rule with the Constitution guaranteeing that everyone's rights will be respected. Under NDAA you won't have that. You'll have the military doing what it wants. If that sounds like a bad deal to you then contact your Congressperson and tell them to support this amendment to NDAA. If you value your freedom now would be a good time to send that email. Do it now.

FBI abuses the rights of the people
To Eric Holder: Stop Lying About The PATRIOT Act
Senators Ron Wyden and Mark Udall have been blowing the whistle: Law enforcement is using a secret interpretation of the PATRIOT Act to spy on people who aren't connected with terrorism. The FBI operates under a cloak of secrecy, so we only know about this because these two courageous senators are defying the intelligence agencies and speaking out. Here's the New York Times:
Mr. Wyden and Mr. Udall have for months been raising concerns that the government has secretly interpreted a part of the Patriot Act in a way that they portray as twisted, allowing the Federal Bureau of Investigation to conduct some kind of unspecified domestic surveillance that they say does not dovetail with a plain reading of the statute.
Wyden and Udall deserve our support. They just wrote a letter to Attorney General Eric Holder demanding that he come clean -- will you sign on at right to join them?
PETITION TO ATTORNEY GENERAL ERIC HOLDER: Stop misleading the public. We stand with Senators Wyden and Udall and demand that you come clean about how you're using the PATRTIOT Act

Looks like the Patriot Act is being misused and in the interests of freedom we have to call them on it. The FBI is not the SS nor are they the KGB so they don't need to act that way. This is a democratic republic where the rights of the people are safeguarded. Time for us to exercise ours.

Down to the wire
I received the following from Demand Progress:
It's do-or-die time: The House Judiciary Committee will likely pass the Stop Online Piracy Act THIS Thursday. Once the bill moves out of committee, the House can pass it at any time.
BUT, if we're able to kill it at this stage it'll probably never recover.
That's why we need your help this week: We want to make sure people understand what the Internet could be like if SOPA passes, so we're asking millions of people to protest censorship as part of our #CensorshipEverywhere campaign -- use our tool to censor parts of your own posts to Facebook, Twitter, blogs, and anything and everything else.
Click here to use our #CensorshipEverywhere tool to send a "censored" message to your friends -- to "uncensor" it, they'll need to contact Congress too.
The most important thing this week is that EVERYONE join the protests in some way. If all of us drive our audiences to make phonecalls, we're unstoppable. We need to jam Congress's inboxes and melt their phone lines if we're going to stop SOPA.
Our goals for the week are one call per congressmember per minute -- and one million emails: Please click here to censor your posts and then make a call or send an email, or do both right away -- it'll really only take a couple of minutes.
SOPA threatens the livelihood of the best parts of the Internet, and the best companies that use the Internet. More than 70 representatives from leading tech firms -- like Tumblr, Foursquare, Etsy, Kickstarter and Reddit -- and advocacy groups from across the political spectrum participated in a meeting to coordinate action against SOPA.
It was an inspirational meeting, and we're all going all-in to kill this legislation. We need to do everything we can to stop it in committee -- and everything we do this week sends a strong message to lawmakers: voters do not want this bill.
Please be part of the effort: Click here to call or email your member of the House of Reps right away. We need to flood them with contacts well before the vote this week.
Join us and be a hero for Internet freedom and free speech.
To contact your Congressperson click here
This is great because if we can kill this bill in committee it'll be a lot easier. If Internet censorship infuriates you then contact your Congressperson today and protest SOPA. These are your freedoms so you may want to protect them so send in those emails.

Hillary Clinton is anti-censorship when it comes to the net
It's official;hell just froze over. It appears that Hillary Clinton and I are in agreement that internet freedom is a right to be enjoyed by all American adults. Here is what I mean, from Demand Progress:
We Agree With Sec Of State: "If The Internet's Not Broke, Don't Fix It"
We sure weren't expecting it: Yesterday Secretary of State Hillary Clinton gave a truly visionary speech about Internet freedom -- about the human right to a free Internet.
It culminated in these profound words about how governments should engage with the Internet: "If it ain't broke, don't fix it."
Some forces in the Obama administration support Internet freedom. Others want to ram through the Internet censorship bills backed by Hollywood, Big Pharma, and the Chamber of Commerce. As our government considers instituting its own Internet censorship regime, we need to support those who stand with us. Let Clinton -- and her boss, Obama -- know that we stand with her sentiments: They need to keep the Internet free.
Will you sign our petition to Clinton and Obama? You'll generate an email to the White House that says this:
PETITION TO PRESIDENT OBAMA AND SEC OF STATE CLINTON: Secretary Clinton's remarks on Internet freedom were prescient and profound. We need to stand by her sentiments: If the Internet's not broke, don't fix. Please ensure continued Internet freedom by opposing the PROTECT IP Act and the Stop Online Piracy Act.
Please just fill out the form at right to support Secretary Clinton.
Also sign the petition while you are there to safeguard your rights. Also the House is going to vote on SOPA next week so you can call or email your congressperson and let them know you want SOPA torpedoed as soon as possible. You can contact them here.

Legislation would give miltary the right to patrol the streets
I received the following from Demand Progress about the military doing police functions:
Ask Obama To Veto Indefinite Military Detention of AMERICAN CITIZENS
An unimaginable violation of due process: The Senate just voted to allow the military to detain American citizens indefinitely -- without even charging them with a crime -- if they are said to be suspected of terrorism.
As Senator Dianne Feinstein put it, "Congress is essentially authorizing the indefinite imprisonment of American citizens, without charge" if the bill passes as it's currently written.
Thankfully, President Obama has threatened to veto the bill, noting that:
Applying this military custody requirement to individuals inside the United States, as some Members of Congress have suggested is their intention, would raise serious and unsettled legal questions and would be inconsistent with the fundamental American principle that our military does not patrol our streets.
Obama will only have a few days to make up his mind: Will you urge him to make good on his veto threat? Just fill out the form at right.

Please sign on at right to urge Obama to veto the legislation -- doing so will generate an email to the White House.
It looks like our Consitutional rights are on the chopping block again and we have a petition to sign to let's get to it. If military checkpoints are un-American to you then by all means sign this petition.

PETITION TO PRESIDENT OBAMA: We urge you to stand by your threat to veto the new National Defense Authorization Act. Allowing indefinite military detention of American citizens -- without even being charged -- is an unfathomable violation of due process.
Please sign on at right to urge Obama to veto the legislation -- doing so will generate an email to the White House.
It looks like our Consitutional rights are on the chopping block again and we have a petition to sign to let's get to it. If military checkpoints are un-American to you then by all means sign this petition.

The good and the bad at Demand Progress
I received the following from Demand Progress:
Great news: 100,000 people have asked Senator Wyden to read their names during his filibuster of the dreaded PROTECT IP Act.
Worse news: This legislation could come to a vote as soon as later this week.
But the nastier we make this prospective filibuster look, the better the chance that Senate leadership won't even call for a vote.
Will you help us muster more troops? Please consider posting a link to StopCensorship.org on your blog or website, and share it with your friends:
Here's the message Senator Wyden's office issued to Demand Progress a few days ago, asking for more support from Internet users:
The filibuster affords senators an opportunity to stand up for what they believe in and there are few things I believe in more than ensuring that every American has a voice and an opportunity to get ahead.
Right now, the Internet gives every American that voice while making it possible for every entrepreneur, thinker and innovator to compete alongside the biggest and most moneyed interests.
It is my hope that -- with your help – my colleagues in Congress will realize that a free and open Internet is something that we as Americans should celebrate and not allow those special moneyed interests to quash.
It is my hope that – with your help – my colleagues in Congress will realize that PIPA/SOPA are the wrong way to protect intellectual property because the price they exact on the Internet is too high.
With your help, I believe we can get that word out and prevent these misguided bills from every reaching the House and Senate floor, but if they do reach the floor you can count on me to stand up and make our voices heard.
Let's make it clear to the Senator that we have his back, and that we plan to stand with him on the floor of the Senate.
I believe they are talking about this. If you haven't signed the petition then please do so.

Let's send Congress a reminder
I received the following from Demand Progress:
More Than 700k Have Acted: Let's Finish Strong
It's been a show of force like no other: More than 700k anti-censorship contacts have been delivered to Congress so far this week, as the Blacklsit Bill gets heard in committee.
What an amazing day -- let's top it off with one more push. Please send one more message to Congress -- even if you already have -- touting our numbers and telling them they need to back down. Let's make it clear that the Internet has risen up, and won't back down until Congress heeds our calls.
Please just use the form at right to send one more message to Congress.
The Stop Online Piracy Act would ruin so much of what's best about the Internet: It will give the government and corporations new powers to block Americans' access to sites that are accused of copyright infringement, force sites like YouTube to go to new lengths to police users' contributions, and put people in prison for streaming certain content online.
Just use the form at right to send one more message to Congress to help us finish strong today.
And please use the links below to ask your friends to join -- and if you ahve a website, please link back to our petition page.

Good news indeed but there is still another petition that needs to be signed so if you are believer in the Constitution and the protections it affords the people you may want to sign it.

Stop the FCC from censoring the net
I received the following from Demand Progress that there is a bill that will allow the government to censor the internet through the FCC. The bill passed the House and is now in the Senate. It is sponsored by Kay Bailey Hutchison (R-TX). Here is what Demand Progress had to say:
Net Neutrality is under attack: Big Telecom is ramming a resolution through the Senate to undermine existing Net Neutrality regulations and ban the FCC from enacting protections in the future.
Will you urge your Senators to stand strong? Just fill out the form at right.
As The Hill newspaper notes, "Sen. Kay Bailey Hutchison (R-TX) said she will push for a Senate vote on a resolution of disapproval to negate the regulations this fall. A similar vote passed the House earlier this year but stalled in the Senate."
Just fill out the form at right to email your Senators.
To fill out the petition click here. This is a bullshit move by Congress and we need to call them on it. We don't want the net to be censored. Censorship is a violation of the 1st Amemdment and we need to tell Congress we won't stand for it. If you agree with that then sign the petition right away.

Feds implementing the Patriot Act
I received the following from Demand Progress in which they state that the Feds are improperly implementing the Patriot Act by spying on Americans when it has nothing to do with terrorism and they know it doesn't but they will snoop on you anyway:
To Eric Holder: Stop Lying About The PATRIOT Act
From Senators Ron Wyden and Mark Udall: Law enforcement is using a secret interpretation of the PATRIOT Act to spy on people who aren't connected with terrorism.
We stand with Senators Wyden and Udall and demand that you come clean about how you're using the PATRTIOT Act.
Just fill out the form at right to sign the petition.

You may want to also contact your elected leaders in Congress, both houses and tell them you're not a big fan of what this administraition is allowing to happpen under their watch that is a good example of bad policy and it has to come to an end. You can find Congressional addresses in the Men's Resources area. To preserve your freedoms you may want to act right away while you still can.

Ten strikes and you're out
Freedom of expression is once again under attack by the entertainment industry in the form of S. 978. What is S. 978? S. 978 is a bill drafted by the entertainment industry to make it a FELONY to download copyrighted material more than ten times. When you consider that:
As the writers at TechDirt point out, under this bill you could go to jail for posting video of your friends singing karaoke
Source:click here
A lot of videos are streamed here to make a political point but if this bill becomes law then a lot of freedoms will be curtailed. Apparently these big Hollywood entertainment companies feel they can shit on people's right to information but if you step on their rights they scream holy hell. S. 978 is bullshit and if you feel the same way then fill out the petition by clicking on the above link. The freedoms you safeguard may be your own so sign that petition today.
