Firefighter Busted for Exposing Himself to Sunbather Appeals 'Entrapment' Conviction

Robin Garrison, an off-duty 42-year-old firefighter, was walking in Berliner Park in Columbus, Ohio, in May when he saw a woman sunbathing topless under a tree.

He approached her and they started talking and getting comfortable, the woman smiling and resting her foot on his shoulder at one point.

Eventually, she asked to see Garrison's penis; he unzipped his pants and complied.
Seconds later, undercover police officers pulled up in a van and arrested Garrison; he was later charged with public indecency, a misdemeanor, based on video footage taken by cops who were targeting men having sex or masturbating in the park. While topless sunbathing is legal in the city's parks, exposing more than that is against the law.

The case is just one of the more extreme examples of police stings aimed at luring people into committing crimes, a tactic that has resulted in hundreds of arrests, many convictions and plenty of controversy.

Law enforcement officials say that such sting operations are an extremely effective means of lowering crime rates and stopping the criminally minded before they commit worse offenses. From early 2006 to the spring of 2007, there were 160 citations for public indecency in the city, according to an investigation by 10TV News. Among those who were caught in the stings: an Ohio State University doctor, government employees and a retired highway trooper.
But such operations veer dangerously close to entrapment, say lawyers, civil libertarians and defendants who've been caught in sting operations.

At Garrison's trial, his attorney argued that it was a case of entrapment. "Columbus police utilized this topless woman to snare this man," said Sam Shamansky. "He sees her day after day. He's not some seedy pervert."

The argument failed to sway a Franklin County Municipal Court jury that found Garrison guilty of public indecency last month. He was ordered to stay away from the park, placed on a year's probation and fined $250. Currently, Garrison remains on paid desk duty while the fire department conducts an internal investigation into his behavior.

"We want to be held to a higher standard, we are in the community every day and we put our best foot forward, but sometimes we stumble and make a mistake," said Columbus Fire Battalion Chief Doug Smith.

Garrison could not be reached for comment.

Shamansky plans to appeal the verdict on the grounds that the jury wasn't instructed on the definition of entrapment.

Other police departments across the country have dangled other temptations, from big-screen plasma TVs, Xbox 360 consoles and a shopping bag containing a cell phone and an iPod to catch people breaking the law.

In New York City, nearly 300 people, many of whom had no criminal record, have been snared this year through the NYPD's Operation Lucky Bag, in which undercover officers leave a wallet, iPod or cell phone in a subway station and wait to see who picks it up.

Although deputy police Commissioner Paul Browne says the program has helped cut subway grand larcenies by half, critics say that the police have gone too far.

"It's pretty straightforward that this is a police-created crime," said Legal Aid Society lawyer Alex Lesman, who defended a man arrested for taking a bag containing an Xbox video game box, a Sprint cell phone and cash. "The police set this whole thing up. They shouldn't be doing that and luring people in that situation, especially in this age of terrorism where the transit system is always telling you to be on the lookout for suspicious bags."

The judge agreed with Lesman, acquitting his client, Antonio Arroyo. "The police should concentrate their noble efforts on behalf of the city on countering real crimes committed every day," wrote Kings County criminal court judge Matthew A. Sciarrino Jr. "They do not need to manipulate a situation where temptation may overcome even people who would normally never think of committing a crime."

Other lawyers have argued on behalf of their clients that the operation may also violate New York's personal property law, which allows someone who finds property worth more than $25 10 days to turn it in to the owner or the police.

An NYPD spokesperson emphasized that Operation Lucky Bag does not use abandoned property; rather it is property actively left by an officer who is still in the vicinity. In addition, it is used at stations where similar crimes have been reported.

Another sting operation that made headlines involved police in El Paso, Texas, and U.S. Marshals sending out messages to wanted felons stating that they had "won" free Xbox 360 consoles and/or big-screen plasma TVs. The operation led to 115 arrests last month and the police picked up more than $25,000 in traffic fines.

This ploy, which has been used in other cities in recent years, is a new twist on an old trick, because sting operations involving drugs and prostitutes have been around for decades. And though defendants often claim entrapment, that argument rarely works in those kind of cases.
"The definition of entrapment is police activity that induces somebody to commit a crime that they otherwise wouldn't do," said Gabriel Chin, law professor at the University of Arizona. "It's not entrapment to give somebody an opportunity to commit a crime."

Chin explains that entrapment involves an officer cajoling and persuading someone who's resistant to the idea of committing a crime. "Just preying on a predisposition is not necessarily entrapment."

But he said that Operation Lucky Bag seemed to cross a line, especially when compared to longstanding police operations involving officers posing as drunks to lure muggers to take their wallets or jewelry.

"Very few people who see a drunk with gold chains or an old lady with money sticking out of her purse succumb to temptation and assault that person," he said. "But lots and lots of people wouldn't turn in a wallet when it's full of money. You could ask whether it's an appropriate use of police resources. If we really want to criminalize people who do what we don't want them to do, a lot of people would be in jail."

The temptation may just be too powerful. "I've found $5 on the street and put it in my pocket," said Chin. "If I found $5,000 on the street, I hope I would do something different."

The police are planting attractive women half naked in parks. They entice passing males, engage them in conversation, lay back, spread their legs and rest their feet on the men’s shoulders.

After being as friendly and suggestive as possible, they ask to see your penis.

Don’t show it to them. You are being filmed by police. If you show your penis, you will be arrested as a pervert.

Only American police, judges, and juries could think that responding to a seductress’s invitation is proof of perversion. But, hey, you live in America where Christians believe that killing as many Muslims as possible for Israel is God’s work. Don’t expect a dumb Amerikan jury, or a self-righteous Republican judge, or a mindless law professor to understand entrapment.
No, this is not a joke. It is actually happening. Last May in Berliner Park in Columbus, Ohio, Robin Garrison, a 42-year-old firefighter was lured into arrest by a half naked woman under a tree.

In reporting the story, the idiot – possibly some male-hating feminist – who wrote the headline for ABC News describes the above: "Topless Woman Lured Perverts in Police Sting."

Get that, red-blooded American males. You are a pervert if you show your penis to a woman who is seducing you.

The reporter, Marcus Baram, is not indignant about the sting. Neither is Gabriel Chin, a University of Arizona law professor who says: "It’s not entrapment to give somebody an opportunity to commit a crime."

It was Anglo-Saxons who made laws against entrapment. Thanks to law professors like Chin, gullible reporters and jurors, and corrupt police, prosecutors, and judges, Americans no longer have the protection of law. In the Orwellian world in which we now live, a male who succumbs to female seduction is a pervert.

The American police have never prevented crimes. In olden days, the police solved crimes by finding the guilty party. No more. In our time, the police create crimes. And that is why the US prison population is twice the size of China’s, an authoritarian country with a population four to five times larger than America’s.

Some observations about women

I was at a take out place I sometimes go to and today I had to deal with a cashier with an attitude but unfortunately she's the manager so there is no one to complain to. She came off with her attitude and I gave her the "don't fuck with me,bitch" look that I have to give so many cunts today. If she has tude I give her tude back. That's the fucking way it is.

The other day I was picking up my brewskis from the liquor store and I heard one cunt say to the guy she was with that she is attracted to the money (doesn't even hide it anymore) and unfortunately I had to count my money to make sure I could cover the purchase and I did it discreetly or else I would get this golddigger's attention. I didn't but if I did this is what I would have done; there was a box of tampons on the shelf above me. If I had to I would have picked them up and say I was going to get them for my girlfriend or wife and asked the clerk how much they were. I wouldn't purchase them since I have neither a wife nor girlfriend but this would have scared the golddigger off.

Tomorrow is Valentine's Day and so fucking what. It's just a day invented by the greeting card and florist assholes to make a sale on one day. They have hypnotized the women into believing this is "their day" where these cunts are made to feel like "queen for a day" but what fucking good does it serve? It makes women more psycho than they already are and it puts more guys into debt than they would be if this day wasn't celebrated. Feminists are putting down this day but that is hard to understand considering it is women's asses and egos that are stroked on this day and guy's wallets that are raped and assaulted on this day. The way it is set up one would think that it is great for the feminists and it is,no matter what they tell you. No,the real ones who get fucked on Valentines Day are the men,we are the ones who have to come up with a present so that they will be hypnotized by the shiny object and what do they think we just love in return? Sex. That's right,sex. Women are under the delusion that men are sex crazed. What are getting in exchange for your gift to her? Sex. No different that the sex you pounded into her last week just so you could get some fucking sleep so you wouldn't be an asshole around your co-workers and boss and not get fired so you can keep this relationship going with an income while you contemplate whether this shit is worth it or not. When it is put that way it just doesn't seem like a good deal. Now if women gave us something too,maybe tickets to one of our favorite sporting events (if a woman truly loved me she would get me tickets to a Lakers' home game and have my ass parked next to Jack Nicholson during the entire game. Now that is love.) But until that happens it is just another sucker day for men invented by manginas to make an attempt to satisfy women when in fact it is imposssible to satisfy them. So what am I saying this Valentine's Day? Get a hooker and thumb your nose at it.

January 25, 2008 -- A Manhattan jury began hearing a harrowing child-murder case yesterday - this one accusing a Harlem "momster" of abandoning her 23-month-old son to an agonizing, slow death after he was beaten by her lesbian lover.


Murder suspect Zahira Matos, 23, cried silently at the defense table as prosecutors used an overhead projector to show a photo of the bruised and bloody body of her son, Yovany Tellez Jr.
The boy's unclothed corpse was covered head to foot with some 40 bruises. His ribs and right ankle were broken, and his internal injuries included a cut to the liver that nearly severed the organ in two.

Matos is accused of murdering Tellez by recklessly failing to call 911 for as many as five hours after her drunken lover, Carmen Molina, 35, gave the boy an obviously fatal beating in their Grant Houses apartment for having soiled his pants.

Molina is currently serving a 15-years-to-life prison sentence for Yovany's murder.
"She sits here today for what she did, and most importantly, for what she did not do," prosecutor Kerry O'Connell said of Matos.

The boy died because Matos, who was barely 20 years old, had just given birth to her third child - and the couple was forcing little Yovany into potty training because they were too cheap to buy diapers for two children, O'Connell said.

"There was beer in the refrigerator, but not enough money for diapers," the prosecutor said.
